The domain effectively never leaves UK though does it. As its still under Nominet control. So you could try and say you bought it fair and square in Mogadishu if you like but imo its going to fail miserably.
It doesn't have too? Market overt has to do with transaction location not that of goods,,,
 
Market Ouvert isn't applicable in UK. Nominet is based in UK. I've no idea where you're going with this but it doesn't appear to be anywhere sensible :laugh:

It would be absolutely impossible to pass good title to a stolen domain name outside of UK, as it could be taken back via Nominet and the UK legal system...

Never been sensible :) I suppose I was just wondering what nom would do if some sly registrar / employee hacker etc registered uk rights unbeknown to the co.uk registrant (used a registrar in a member state market overt still exists) Then sold/kept them etc. As you can buy stolen antiquities, art etc that has market overt gained in another member state making it legally yours in the uk even if stolen here why would a domain be different ?

okay here is the longer version of my post:

The seller has deliberately ****** the buyer over. He has registered the .uk after the negotiations were done.

The buyer should have known better. It was naive to assume the seller was honest.

Sedo know there are major issues with the UK system but couldn't care less, they're knowingly letting it continue.
