Interesting! Do the new rules mean a registrar can transfer a domain to another tag without registrant's knowledge/consent prior to deletion, so it can be renewed/caught on another tag by 'interested parties'?

Nope

The rule is the registrant must give explicit consent to the registrar before they can take over the domain

The problem is no one is checking if the registrar has been given explicit consent so seemingly they can do what they like.

E.3.6. You may, no earlier than 30 days after the expiry of a domain name on an Accredited Channel Partner Tag, take steps to transfer the domain name into your name, provided that you have previously informed the Registrant that you intend to do this and obtained their explicit consent to your doing so. Such consent must be obtained no earlier than 30 days before the date on which the domain name is due to expire, and no later than 30 days after the date on which the domain name expired. Even if you transfer a domain name in these circumstances, the original Registrant of the domain name must always retain the right to renew the domain name in question as set out in paragraph B.1.13 above. You may not transfer a domain name into the name of a third party under this paragraph;

More to the point, nobody has defined what "explicit consent" consists of - we should not be too hasty to jump to the conclusion that no consent has been obtained (though it may have been obtained in a manner than many on here would deem "less than transparent") because that's tantamount to making an accusation of theft.

The original registrar may well have done "something" that it believes legally maps to "obtaining explicit consent" before passing the domain across internally within the group (if that is indeed what happened in this case).

I asked nominet to define "explicit consent" when I reported this about 2 weeks ago, but I was told the person dealing with this is ill, so presumably only 1 person out of the 100+ staff actually knows what "explicit consent" is :p haha just being a little facetious.

I asked a few weeks ago, but the response was a bit wishy washy, this is what I was told in an email

Yes, you would need to prove that you had explicit consent in the timescales indicated – so I understand this is more than likely to be something from them in writing.

As far as I can make out, the new registrant "Identity Protect Limited" is 123-Reg's privacy company. Looks like this one is is being syphoned off to their own portfolio.

This name was booked with DM so they may well be using client bookings to identify decent names. Anyone here book iapp.co.uk at DM?

iapp.co.uk was caught by Hubbard Media/DropSystem back in 2010 so the previous registrant was likely a domain investor. It would be interesting to know if he gave DM "explicit consent" to transfer the name.

Yes. Exactly the same as normal except they are renewed at the last moment, just after 12 on drop day.

I wouldn't think Behrendt were an accredited registrar? They don't seem to be on the surface at least.. :confused:

I think you're right Dave, looks like that was renewed normally on Friday. I screwed up my hosted catching list, which threw me off.
 
If these original registration dates are going to stay in place (last minute renew on the drop date) .uk rights will remain intact. Pretty sweet.
