What am I up against!?!?

Registrars have a 62 day window to obtain "explicit consent" but we don't know what Nominet consider obtaining such to be acceptable.

Will Registrars be allowed to obtain that explicit consent as part of the terms and conditions at the time of domain registration? If so, even if obliged to send reminders, Registrars will take control of a good proportion of the best potential drops very easily.

It says they must obtain explicit consent no earlier than 30 days before the date on which the domain is due to expire.

So I can't see how it could be hidden in their terms and conditions when it's created or renewed etc, since that would be a much longer time period than 30 days
 
I stopped catching domains in 2007 or there about. Domain catching is very very competitive now, for the few domains that drop. The time and the effort newbies would need to put in to have some sort of meaningful outcome is significant. Also the future of this practice is not bright. For people thinking about it I would suggest invest time in to learning skills like programming, e-commerce platforms, data mining so on. That has better future than domain name catching.
 
What nobody knows is what Nominet consider notice of "explicit consent" to be because they haven't told us. Furthermore Nominet don't appear to be requiring that either the registrant or the registrar directly notify them that "explicit consent" has been given. I suggested that explicit consent is flagged at the registry and indicated that it has been given in the WHOIS with a "pending registrar takeover" status. I don't believe any of this will happen and it will be taken on trust.

None of this goes towards confirming who will legally be considered the registrant of a domain name after the 92 day expiry period if the registrar renewed it and the registrant didn't respond to communications from the registrar.

Here's the scenario I am thinking of. When you register a name, the terms and conditions state that the Registrar may take control of the name if it is not renewed. The T&Cs will also state that before this happens, explicit consent will be sought no earlier than 30 days before the date on which the domain name is due to expire, and no later than 30 days after the date on which the domain name expired. What is stopping a Registrar stating that should they receive no response from the Registrant within X days, then explicit consent will be assumed to be given, based on the acceptance of the T&C?

With such a poorly defined objective existing to justify this whole exercise, it looks like nothing other than pampering, providing a greedy right to a domain name for which the registrar has never historically paid.
