WeightedVoting.uk has obtained two opinions from Iain Mitchell KC. They deal with whether Nominet's weighted voting is lawful and whether Nominet currently has the power to collect member subscriptions.
Based on the information available, Counsel concluded that:
We waited until after this week's board meeting before publishing the second opinion and our most recent letter, in which we asked the board to work with us to fix the "mess" counsel described. When we did not hear back from Nominet. With the AGM looming, we decided to publish and give members and stakeholders the information that we have.
You can read the two opinions and our letters to the Nominet board at WeightedVoting.uk
We'd ask members who agree with us that this needs urgent attention to sign up to show that they support that call.

This is not a new issue. It's been raised before, including before and then at the 2020 AGM, when Mark Wood confirmed that Nominet's legal advice was that it was lawful. You can see him deal with it here.

These are fundamental questions of Nominet's governance, dealing with how the AGM and election takes place. Please any questions you may have about it. We'll do our best to answer them.
Based on the information available, Counsel concluded that:
- Weighted voting is "clearly unlawful" and "void"; and
- Subscription demands after 31 August 1997 are "void"
