Who represented Michael?

I had heard Nominet was in there as well - unsure of the finer points but no doubt the judgement will make interesting reading!!

Definitely, does anyone know if there's much UK case law that relates to domains. I know many of us have similar domains to this and if Michael loses it sets a damaging precedent...

I think there's probably less damage in a loss compared to the greater damage to the DRS system if there is a win to be honest.

The prospect of this going to court without Nominet chipping in about the virtues of the DRS seems unlikely. A decision in favour of Michael is sure to raise questions about the DRS and its methods of implementation.

The barrister said that sometimes you need to know when to quit, morally I was right but proving goodwill would be very difficult and I could easily throw £150,000 at this and lose.

Health is more valuable than any asset.
 
Without wanting to encourage Toth nor to be seen blowing smoke, he does have the resources and perhaps the yorkshire belligerence (or stupidity! ;) ) to go all the way with this - as he has done before on some others.

Fair play to him whatever the outcome.

Agreed Ratty, but principles are up there with health. People die for their principles. I know this is only a domain but it is about being a bullied by a huge corporate, it's the age we live in.
I actually really admire Michael for taking this stance. Also the other 2 domains mentioned were pureplay generics too. So I consider him very unlucky .

I just hope to God he wins and judge makes judgement the airline cover all costs and can't come after again. This is the final decision.

I mean, the legal costs are prob big, the trainfare t'London alone would have most Yorkshiremen spitting blood :D

Do trains run from the wilderness I thought everything passed the Watford gap was a heritage museum were you can drive through it and see how people used to live back in “t” day
 
Ummm... this is defo a close one.... United Arab Emirates... i think that is a name that is strong enough to envisage the place being shortened to a 'emirates' and in fact unless the airline owns 'emirates palace' then they cant claim unequivocal rights to the name 'emirates' ... clearly they want the domain name or why dont they claim emirates palace !!
 
They won the .eu think about 2 years ago and most people knew then that they would then use that to try get the .co.uk.

From memory the only reason they won the .eu case was because Mr T didn't have our good friend Mr Davies representing him at the time, tut, tut :p

Good luck to Mr T this time around though - I would have done exactly the same and taken it all the way... If i believe I'm in the right (like Mike does), I'd through money at it all day long as i dont like the idea of being bullied by large corporates / PLC's, never have, never will... and i think mike is of the same mindset.

Are you sure? Out of the six DRS cases that "GPL" is noted as a Respondent in five of those six weren't responded to. Admittedly two of those five turned out as wins, although the case "GPL" did respond to was also a loss. Based on that track record of general responsiveness I am not convinced that "GPL" would actually have "taken it all the way" or "through (sic) money at it all day long". :cool:

re-read my post, the keywords used were " If i believe I'm in the right ", clearly i didn't regarding those cases so I didn't waste my time getting my legal guys involved... however i suggest you read my recent Furnitureland case V's Furniture Village Ltd, not only did I win the drs and the appeal, i also revoked trademarks and in the process of removing further ones too :)

and no i wasn't joking... the whole emirates.eu case was a joke, mike was just unlucky their with his choice of lawyer, and thats a fact if you looked at the case... plus they dont even own the name now as they are not a company residing within the European Union which means they are not eligible for a .eu name, which meant they couldn't renew it, which intern meant it expired and was picked up by someone else, total joke!

Wish mike the best of luck with the .co.uk

They should have just offered him a wodge of cash considering its a generic and not a TM.
