I had a very similar issue with a merchant on AWIN. In fact it got pretty serious and I received multiple mails/emails threatening legal action. I was in the wrong but as far as I can tell the issue is purely down to your content. Don't use the trademark or associated trademarks in title elements, links or copy and you should be fine.

But to base this purely on your search ranking is borderline ridiculous. In fact it would potentially be worthwhile attempting to rank your competitors for the trademark and then reporting them to the merchant.
