in this case the reason for the original decision came down to the claimant stating that the registrant was aware of them and their rights at the time of registration and the respondent not refuting that in any way

An LLL domain cannot reasonably be 1-to-1 linked to a company that a lot of people won't ever have heard of. LLL domains are valuable precisely because they have a multitude of potential uses.

Having a trademark on a three letter name should not be enough to own those letters in all uses, and therefore cannot be enough to order a transfer. The respondent should not have needed to respond IMHO.

Reading the reports and my opinion of what is fair and reasonable.

No, not Nominet, but rather the Claimant.
The t&c could state that if you bring forward a DRS claim and win, but which subsequently is overturned by an appeal then you will be liable for the cost of the appeal panel.
Similar to a civil law suit

You can't blame a claimant for a Nominet expert making mistakes. It should be Nominet who cover those costs.
 
No, by doing that you make sure only claims with a strong case / high probability of winning will be brought forward. Reduces reverse highjacking and the cost of defending against them for the registrant.
