Guys,

I'm on the brink of purchasing a domain for a decent amount, however the seller will only accept BACS. I don't know the seller, though he seems legit.

What protection to I have?

You should do your home work and found out who is the seller. I believe I am the seller you are referring to but to be honest i don't think you done any checking.

It’s not confirmed but I believe I am the seller.

As to why I insisted only on BACS payment - because I checked little bit about Rich, and he seemed being capable of doing his research about me . I gave to Rich amazing offer with condition of direct deal because going escrow would not be best use of my time for that kind of money.

Also there would be cost to the buyer. I always try to give best deal and advice to the buyer. Some of you know me well, those that don’t - I been selling domains since 1998 and when I see perspective buyer, I can rely on my experience.


Lets say someone going in to direct deal and after payment domain is not transferred. I believe, if there is obvious signs of fraud only then the police would get involved. If the person/company can be traced and there is evidence of legit business activities I believe police would say its civil matter and one shall proceed trough small claim court or so.

Totally agree with you Max, and yes you are the seller.

On this occasion I should have spent a little more time doing my research, however I didn't have any doubt after a few scans via the web.

Anyway, now we all know a bit more about transactions etc after this thread ;-)

ASk for a copy of passport and utility bill and a signed contract of sale.

It would be extremely foolish to hand over a copy of your passport and utility bill to some random person. I think if you asked someone to do that you're likely to kill the deal.

I'm sure you needed to send ID to transfer names on the old Nominet paper system as late as around 2007. I remember being concerned about it at the time.

As for me when buying, I ask them to change the nameservers over before sending the money. Problem is of course that you might think that you might think you are dealing with someone trustworthy because their name is on the whois and they have a good rep, but it may not be them you are chatting to. Simple way to check that you are dealing with people in charge of the name is to get them to change the nameservers.

Never really needed escrow and buyers never really bothered about asking in the past.

For another time tho:
If your sending Passport details or driving licence, I would black/white out the critical details such as passport number, d.o.b etc. This can be done in "Paint"
on windows PCs.

Re changing name servers, Cheers for the tip greywing.

Asking to change name servers is good method to verify that you are dealing with right person. Not always seller will agree to change name servers and rightly so, because “the buyer” could be just looking to test the domain without committed intention of buying it.

In such event “the buyer” would be committing fraud. I don’t recommend anyone doing so. Contract law is very clear. If you commit to a deal, even if that was verbally or simple email message, the commitment is contractually binding. Seller who lost out, can pursue the case trough the courts and get compensation for lost revenue and expenses.

Also the seller may not wont to change name servers for few reasons. So other WHOIS fields (eg. Trading as: ) can be change to verify that seller has an access to domain.

There few other ways.

It could be risky business for seller to change name servers to buyer’s before the payment. I have seen one case, after NS change buyer started using domain immediately. Third party which had trademark for that term probably has been watching the use of domain and they saw that TM infringement has started. They filed DRS within a week and won the domain. Seller never received payment and also lost the domain name.

I have to add, that seller did not have clue what is DRS and what is abusive registration. Their defence was weak.
 
Rich, if it is Max that you're dealing with, I'm happy to vouch for him and I'm sure many others would as well. Pay him the money by BACS, get your domain and get earning some money ;)

Centrally with you we have done few different deals. First one if I am not mistaken was about 10 years ago pit****.co.uk.

I have done many deals with many other AD members and vast majority is great to deal with.

I have to admit that I know people on this forum that have not completed their deals . Including braking out the contract on Sedo.

I am having identity crisis, so for those who still do not understand. Rimvydas Karpavicius / Rimvydas Karpis / Max Karpis – is same person.
 
Hard to believe that buyers/sellers don't know how to verify a seller/buyer.

You nail them (privately) If it doesn't add-up (never happened to me) your prepared to walk away.

The day I trust my decision making to a consensus of opinion "on aboard like Acorn" says 'your lost' without a cause' (due respect to Acorn Members) but, there has been a lot of "Well I wouldn't have a Clue" but let me tell you what $50 means to me. (kinda references/advice)

It was a stupid posted question in the first place
