Football domain name and the FA copyright

Wow. Just wow. I came back from holiday, thought I would check on the thread in case someone had replied while I've been away and I thought there was going to be plenty of feedback for me when I saw how many replies there had been.

Then I read over 3 pages of nonsense

when you ask for an appraisal on here you have to accept the good and bad, most if not all of the people are only being honest with you. If it was me I would prefer the truth rather than be given false hopes.
 
I was wondering if anyone has any experience regarding copyright and domain names.

In short, I'm thinking of starting a website about the England football team - a fan site and I will do news articles as well. It will have "England Football" in the domain name.

However, I don't want to wake up one day and find a cease and desist email and/or a copyright notice from the FA as I would assume they don't want/like fan sites as there's nothing for them to gain out of it.

To be clear, I have no intention whatsoever of copying anything from thefa.com or even getting the smallest bit of inspiration from it.

I've been watching football and designing sites long enough to make my own site without having to copy ideas from elsewhere.

Does anyone see any potential problems with something like this?

Why not simply contact the FA directly and ask them? They will give you the definitive answer you are looking for.

wtf? Clearly you didn't read the thread in its entirety because if you did, you would realize that most of it is an argument between two people and nothing to do with what I started this thread about :rolleyes:
 
If its Premier League related (i.e about the Premier League or a Premier League Club) then I'd be more inclined to contact the Premier League, as they deal with all the licensing for the top flight clubs, not the FA.

I agree with Invincible, that questions is incomplete.

As a rule you need to be aware of existing trademarks. Easy to do - just play with IPO online tool and you can get all data you need.

If there no similar registered trademarks, then you need to be sure that there is no established use of same or similar name by someone else.

If you done that and it seems OK , the you should be OK.

Here are some examples.

Let say there is UK trademark “Play Football” and you create website “Play Football England”, trademark holder could argue that it’s too similar.

It could be dodgy ground, it depends what they've secured in the way of trademarks I'd suspect, for example I had a site promoting Wembley Tours and Wembley didn't like me bidding on the term Wembley in PPC ads but didn't actually contact me about having Wembley in the domain name.

Regarding the comment about Premier League stuff, Chelsea actually had their lawyers contact me about another site, they were protecting ever single term you could think of to do with Chelsea, surprised they didn't even try to do me for using the word 'blue' and 'plastic flags' :D
