Apraisal is sueable being honest as your taking their name and using it for a start and they have a very strong case against you as they can say that you are trying too con people into giving money etc etc.

Would be 10 times worse if you had a website up.

Have you actually seen what they have trademarked, if it is Escrow as a brand name, or if its the www.escrow.com website that they have?

If they have been able to brand name the name Escrow as there company name, then it might be sueable, but as someone pointed out this is a name in the English dictionary so they might not be able to do that.

So escrowfunds is probaly all well and good until someone poses as escrow.com and tries too defraud money so if someone says hi escrowfunds is part of escrow but the UK version then its sueable for attempt to defraud as well as trademarks.

If Escrow is a trademarked company then yes it is in breech of the trademark so unless you find what is trademarked 100% then neither of us are right or wrong.

I never mentioned www.escrowfunds.co.uk was trademarked, what I said was that Escrow might be trademarked and therefore someone using Escrow might be breaking trademarks.

So the keyword is Escrow and not the funds part if they have trademarked Escrow rather than www.escrow.com as a domain name then as your not using Escrow in the sense that your calling yoursel www.escrow.com then things should be ok.

If you or someone else who buys the www.escrowfunds.co.uk is using the domain pretending to be escrow.com then obviously yes there is a trademark issue.

Why would someone using EscrowFunds.co.uk trade as Escrow.com ?

It does highlight the pitfalls of using generic names to trade off though.

and you know how much Paypal would screw someone, they close accounts fast enough so when it comes to using their name god knows what they would do.
