Just call nom for advice, they should be able to sort that for you. Or just let whoever has control over it at the moment build a nice new site on it, get's it ranked and then claim it back.
 
Yep - but not in my nom account because the email has been changed

I sincerely hope that this isn't the case. Registrars might be able to get away with this in the .COM market but the .UK have much stricter guidelines on what a registrars can and cannot do.
As GreyWing says, phone Nominet ASAP and deal with them direct. If they have done this then I'd advise changing registrars.

Technically you could do it if you had control of the email address via nom, as whoever had the email address with Nom could send themselves a transfer email and then change the whois.

Very very very dodgy and I hope that kind of practises never happen over this end of the pond but technically possible.

My view of this incident is probably a cock up rather than conspiracy on someones part.
 
I had already contact DomainMonster and was told the following

"xxxxxxxx.co.uk was kept in our portfolio account after you decided not to renew it. Obviously we did wait till we were sure you were not going to renew this, before moving it over. This is sitting with a new owner now, who purchased the name, and this domain is being handled by our after market team. The new owner has been told to get the name changed on this domain as a matter of urgency, or you will obviously hold the right to reclaim this as you choose!"

The domain is a registered TM which is why I let it drop so I've contact nominet to ask them to sort it out.

A bit off topic but I was letting a name drop and and DM renewed the domain before it went to suspended. Apparently they had a buyer lined up!

Don't know if this is normal with registrars but seems a bit unfair to me.
That doesn't seem right at all. Have you checked their terms?

As with this, registrants are agreeing for this to happen in the terms, not sure how all this fits in with Nominets terms for registrars but if it's a loophole the dropcatching market is about to change!

I'm awaiting clarification from Dawn at Nominet regarding both registrars and will post her response when I hear back.

As far as I'm concerned it's a clear violation. As soon as the winning bidder transfers the name to themselves via the normal Nominet transfer process, its theft pure and simple. You have to tick a box before requesting a transfer stating that you are the legal registrant, or an agent acting on behalf of the legal registrant, something along those lines – this is clearly not the case in these instances.

Update: this is the official wording...

"I am the registrant, or I am authorised by the registrant of the domain names specified in this transfer, and I am authorised to transfer them to a new registrant."

There are so many other reasons why this is dodgy I could be here all day. Just hope Nom nips this shady practice in the bud asap before it gets out of hand.

Rob I'm not complaining about my thread being jacked because I'm finished with it but don't you think when you get a response from nominet, you should start a new thread ?

I say this because when you use the new post button it still reads 'Domain monster catch cost' so users will just think it's an old story ;-)
