Remember a business can have exclusive rights to a name even if the name is not trademarked, be careful! I also don't recommend contacting them by email in regard to purchasing certain domains. This can and most definately will lead to DRS in many cases! Should they decide to take it through these channels regardless of your price it will weaken any future cases you may encounter. Phone calls are the best method imo. Gud Luck!

DRS cases are £750 + vat minimum.
I'd imagine they'd settle for the purchase.

To start with I understand that its illegal to tape a phone call without having advised the other party that you are taping the call first.

Second, they can offer you any amount of money on the phone but you haven't 'got them' because an offer made on the telephone isn't going to stand up in court, especially not when the evidence has been collected illegally. I appreciate you have the bare bones of a contract (offer and acceptance) but without that being on paper you don't stand a chance.

1.well ive just spoken to the Information Commissioner to check this and it is very complicated .Basically if the data (phone call) you are collecting is "business data" then you are OK recording without telling the caller/recipient" IF however the data could be classed as "personal data" then if you did not tell them you would be in breach of the 1st principle of the DPA in the method of collection of personal data.
Given it is uncertain I would agree with Netserve that it would be wiser to tell them ,unless you are certain you can prove it is "business data" and not personal.

2. An offer and/or acceptance on the telephone does stand up in Court IF you can prove it. You merely plead that they said it and the Court will either believe you or it wont,but if other side know/thinks you have taped the call they are not,hopefully, going to commit perjury.You are right though that it is much better to have it in writing.

There is also the question of ethics, do you really want to be known as a serial cybersquatter?

It is something to weigh up, do people really think its worth developing a vexatious reputation for the sake of a few quid?
 
Rob you are correct on that.No of course its not the best course at all. Best to have a quiet unlitigious life if you can. I know the info sounded like I was advocating getting into all sorts of litigation, im not.

ATM they only sign up via phone.
You cannot sign up online but PremPlus still gets about 150 hits a month (with no weblinks).
I suppose if they decide to offer online registration for PremPlus they'd come looking for me.

Btw, do you think they would own the right to PremPlus.co.uk?
