Is there any risk in owning a .co.uk domain name since 1998 and never using it and refusing to sell it or even state a price when asked ? Is that within the Nominet rules ?

Nominet don't dictate what you do with a domain, and it's certainly your choice whether it is for sale or not. Your only risk is a DRS being brought against you if someone feels they have a claim to it (trademark etc)

What if the TM was registered after the domain was bought ? Do you still risk a DRS ?

I got a sol letter even though I had the name before their trademark. I told them where to go though, whether they will ever chase me again is another matter!
