I am only surmising, but perhaps anyone who has their website indexed by, at least google cache if not google search engine, has a claim against Google for copyright breach ?.

It is going to make things very complicated if such a ruling means that search engines are no longer allowed to index or cache websites without the explicit permission of the copyright holder.

I've always been surprised that google etc and even archive.org can store/replicate copyright material without any recourse....

They may argue that a robot.txt should be set up to stop them, I don't think it should be the case....
 
nice point, but surly this would kill all sites cached.
 
I'm not In theory yes it could..... Most likely Google would argue that a site/site submitted themselves to googles T&C
 
Perhaps it will decide that unless there is a robot.txt accepting google then they cannot crawl the website. Maybe I am wrong but surely strictly speaking a robot
accessing your server is doing so without your permission and therefore problem with computer misuse act ?. Thats why they maybe they will switch from having to refuse to having to accept, google robot.

I believe there is a command for robots.txt that stops cacheing of your website. This is why some websites don't have caches on Google I believe.

However, it is still a good question to be asked. Why does Google need to cache your site for public viewing anyway? :confused:

Look at it from the point of veiw when someone sends you mail or calls your phone or you apply for an msn account........ Unless you state otherwise the law says u are opted out...... In other words you have to make a physical requested to allow or accept and you can opt out at any point.....

Do also keep in mind some images have child protection issues school photos etc
