I've previously posted about 1and1 invoicing for domains that they are not the registrar for.

Every week for the past 2 months, I've received 20 or so invoices through the post from them, followed up by email after email (I removed my card details some time ago so they havent been able to take payment).

They have been invoicing for domains I sold over 20 months ago and that were transferred away to 123-reg at the time of sale.

On numerous occasions, I have told 1and1 this, to both billing and complaints. They insist they are doing no wrong.

Even though the domain names were transferred away (tag change) and nominet transferred, the domain names in question remained in my 1and1 control panel.

1and1 insist this was not a glitch, and that the contracts were current and good.

I eventually threatened to hand the matter over to my solicitor and acused them of harrassment in a roundabout way.

As a gesture of goodwill, they offered to reduce the outstanding amount by 50% to £150. I told them where to go.

This week they have threatened me with their debt collectors and a £15 admin charge on every domain name in question.

123-Reg, the true registrar (and through whom the names were recently renewed) have provided me with details proving the names were transferred to them almost 2 years ago.

I have let 1and1 know this. No further response from them yet, but if they persist, I'll be persuing harrassment and recovery of associated legal costs.

My advice to you all .... delete you card details and check every dealing you have with them. I wonder how many false renewals they have charged people for in the past and got away with.

I second everything that pendragon is saying here and have previously made posts about the many problems that 1and1 have caused me. These include:

1. Overcharging when domains were transfered out before renewal
2. Telling me that they wont charge me any more then taking hundreds from my credit card
3. Ignoring my emails
4. Making it impossible for me to transfer my remaining domains away from them (I had to go through Nominet)
5. I had a 1and1 'customer service' agent swearing at me and hanging up on me because they couldn't understand what my problem was??
6. Forcing me to cancel my credit card so that they would stop taking money from me.

Really stay away from this company.

Even if you are happy with the service you have received so far, consider transfering out before you get caught up in problems where you have money stolen from you - it is like banging your head against a wall to get the money back.

Perhaps all of us affected should persue 'Malicious Communications Act' which I mentioned regarding a different issue a while back...
This Act allows for stiff criminal penalties against people/entites that send out 'malicious' communications, and from a legal standpoint these false bills are Malicious.
Malicious Communications Act 1988 - Wikipedia, the free encyclopedia
Malicious Communications Act 1988 (c. 27)

See (1).1.a.iii:
"Offence of sending letters etc. with intent to cause distress or anxiety
Any person who sends to another person—
a letter or other article which conveys—
information which is false and known or believed to be false by the sender;
is guilty of an offence if his purpose, or one of his purposes, in sending it is that it should, so far as falling within paragraph (a) or (b) above, cause distress or anxiety to the recipient or to any other person to whom he intends that it or its contents or nature should be communicated."

Lots and lots of people hate this company. I use them and have not had any problem with them.

Can anyone suggest a good UK based alternative? Perhaps I should spread the risk a little!!!!

UkReg is owned by Fasthosts which is owned by United Internet which owns 1&1 - Money is ultimately going in the same pot ;)

United Internet have four tags?

Why cant nominet sort 1and1 out? their reseller is acting fraudulantly, why doesnt nominet care?

Because that is 12% of the votes at agm's and non exec votes. I have often said it, when Nom say that people are trying to take over Nom and need protection from Government, they blame domainers but they mean these 4 or 5 companies.

To be fair they may have a point that should scare some of us.

It's a ridiculous voting system anyway, what idiot allowed votes based on domain registration share? and the anti competition tag holding policy is only there to scare off the small operation who can lose or risk everything.

daily.co.uk is recommended , great support and control panel !

Yep I agree mate but now it is there they can't change it without the help of the Government, beacuse the big 4 will veto it or any curbs on their power.

I've had an unusually large bill this month from 1and1.... 4 times its usual amount in fact. I buy a lot of domains, but normally the same amount each month so I'm unsure of the reason for the sharp increase....... Does this ever happen to anyone else?

Since starting this thread, I've complained via email to [email protected]

I've had no response to this email. Today I've received yet more payment reminders / threats of charges for the same old names, despite me telling them I have the documented proof from 123-REG that the names were transferred to them almost 2 years ago.

I have written again to 'complaints' saying if they continue to harrass me in this manner, then my solicitor will get involved, and all legal costs levied at 1and1.

Let's see what happens now.

Why are you complaining to 1&1? Complain to Nominet directly.

Nominet weren't interested.
